1. Scope
These General Terms and Conditions apply to all orders placed via the Triops Galaxy online shop (www.triopsgalaxy.de) by consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
Conflicting or supplementary terms and conditions of the buyer shall not apply unless their validity is expressly agreed in writing.

3. Offer and conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online display. By clicking on the ‘Buy now’ button, the customer submits a binding purchase offer.
The contract is concluded upon confirmation of the order by email or upon delivery of the goods.
4. Prices and shipping costs
All prices are quoted in euros and include statutory value added tax. Shipping costs are shown separately.
5. Payment
The following payment methods are available: prepayment, PayPal, credit card, and any other options specified in the shop.
6. Delivery
Delivery will be made to the delivery address specified by the customer. Delivery times can be found in the product description. We reserve the right to make replacement deliveries in the event of unavailability.
7. Retention of title
The goods remain the property of Triops Galaxy until full payment has been received.
8. Warranty
The statutory warranty rights apply.
8.1 Nature of the goods
Triops breeding kits, egg-sand mixtures, feed and accessories are natural or living products whose success depends on external factors (e.g. temperature, water quality, mixing ratio, light conditions).
The warranty covers only the absence of defects in the goods at the time of delivery, not the success of breeding or rearing.
8.2 Disclaimer for improper use
The warranty shall be excluded if the defect is caused by:
- deviation from the instructions supplied or available online,
- improper handling or mixing,
- unsuitable environmental conditions (e.g. incorrect temperature, tap water containing chlorine, incorrect storage),
- overlaying or exceeding the expiry date.
The statutory warranty remains unaffected if a defect was already present when the goods were handed over.
9. Exclusion of use/instructions for safe use
Triops Galaxy products are not suitable for consumption. Not a toy. Not suitable for children under 3 years of age.
Instructions must be followed (Available digitally via QR code or www.triopsgalaxy.de).
The success of breeding cannot be guaranteed, as it is a biological process dependent on external factors.
10. Right of withdrawal
Consumers have a right of withdrawal. The following are excluded from withdrawal:
- sealed products that are not suitable for return for hygienic or biological reasons if the seal has been removed;
- living or perishable goods (e.g. Triops eggs) with a limited shelf life.

11. Liability
We shall be liable without limitation for intent and gross negligence. In cases of slight negligence, liability shall be limited to breaches of essential contractual obligations (cardinal obligations) and shall be limited to foreseeable damage typical for this type of contract. No liability shall be accepted for indirect damage or loss of profit.

13. Dispute resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
